OUR TERMS AND CONDITIONS

  1. Scope of application These General Terms and Conditions apply to all contracts concluded via the online shop "TschaudisGifsthop" between us, the operator of the shop, and our customers.

  2. Conclusion of contract (2.1) The offers in our online shop do not represent binding offers, but are merely an invitation to the customer to submit an offer. (2.2.) The customer submits a binding offer by completing the ordering process in the online shop. (2.3.) We are entitled to accept the customer's offer within five working days. Acceptance occurs through a written order confirmation or through delivery of the goods.

  3. Prices and shipping costs (3.1.) The prices stated in our online shop are final prices and include VAT. 3.2. In addition to the prices stated, we charge shipping costs for every order. The amount of the shipping costs depends on the goods ordered and the customer's delivery address.

  4. Delivery (4.1.) Delivery takes place within 7-14 working days from the order, unless different delivery times are specified. (4.2.) If we are unable to deliver the ordered goods because our supplier does not deliver to us through no fault of our own, we are entitled to withdraw from the contract. In this case, we will inform the customer immediately and refund any payments already made.

  5. Payment (5.1.) The customer can pay by credit card and debit card, Apple Pay, Klarna or PayPal. (5.2.) We reserve the right to exclude certain payment methods in individual cases.

  6. Retention of title The delivered goods remain our property until full payment has been made.

  7. Right of withdrawal (7.1.) The customer has the right to withdraw from the contract within seven days without giving any reason. 7.2. The withdrawal period is seven days from the day on which the customer or a third party designated by him, who is not the carrier, takes possession of the goods. Personalized products are excluded. Personalized products cannot be withdrawn. (7.3.) To exercise the right of withdrawal, the customer must inform us (Tschaudis Giftshop, Weitblick2, 6038 Gisikon, telephone number: +41 76 480 74 83, email: tschaudisgiftshop@gmail.com) of his decision to withdraw from the contract by means of an unambiguous declaration (e.g. by letter or email). (7.4.) To meet the withdrawal period, it is sufficient for the customer to send notification of the exercise of the right of withdrawal before the expiry of the period.

DELIVERY AND SHIPPING

  1. Delivery (1.1.) We deliver our goods within Switzerland and to selected EU countries. (1.2.) The delivery time is usually 3-5 working days from the order within Switzerland, unless different delivery times are specified. In other countries the delivery time is 7-14 working days. (1.3.) If we are unable to deliver the ordered goods because our supplier does not deliver to us through no fault of our own, we are entitled to withdraw from the contract. In this case, we will inform the customer immediately and refund any payments already made.

  2. Shipping costs (2.1). The amount of the shipping costs depends on the goods ordered and the customer's delivery address. The shipping costs are displayed to the customer during the ordering process. (2.2.)

  3. Delivery to packing stations (3.1.) We also deliver to packing stations if this is specified by the customer during the ordering process. (3.2.) The customer is responsible for ensuring that the packing station specified by him is suitable for accepting packages and does not exceed the maximum size of the goods to be delivered.

  4. Delivery to different delivery addresses (4.1.) The customer can specify a different delivery address during the ordering process. (4.2.) We do not deliver to PO boxes or military facilities.

  5. Shipment tracking (5.1.) The customer receives a shipment number with which he can track the shipment online. (5.2.) We are not responsible for delays or failures in shipment tracking by the deliverer.

  6. Refusal of acceptance (6.1.) If the customer refuses to accept the ordered goods or does not collect them from the post office within the collection period, we are entitled to withdraw from the contract and take back the goods. (6.2.) In this case, we will refund the customer the purchase price less the shipping costs and a processing fee of 6 (CHF) Swiss francs.

  7. Damaged goods (7.1.) If the delivered goods are damaged, the customer must report this to our customer service within 48 hours of receiving the goods, with a photo as proof. (7.2.) We will then arrange for a replacement delivery or refund the purchase price.

  8. Lost shipments (8.1.) If a shipment is lost, our customer service will clarify the case with the deliverer and inform the customer about the status of the investigation. (8.2.) If the shipment is not found within 14 days, we will arrange a replacement delivery or refund the purchase price.

  6. No warranty (6.1.) We do not provide any warranty for the quality or suitability of the goods we sell. (6.2.) We are not liable for damages resulting from defects in the goods.

  7. Other exclusions of liability (7.1.) To the extent permitted by law, we exclude any liability that goes beyond that stated in this exclusion of liability. (7.2.) This exclusion of liability also applies to our employees, representatives and vicarious agents.

  8. Severability clause (8.1.) Should any provision of this disclaimer be or become invalid, the remaining provisions shall remain unaffected. (8.2.) The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
